1.1 About Us

This website, theworldofkolgennon.com, is operated by Lewis D'Ambra, trading as The World of Kolgennon, a sole trader based in 4 Royal Oak Road, Sketty, Swansea, UK SA2 8ES. You can contact us at theworldofkolgennon@gmail.com. References to "we", "us" and "our" mean Lewis D'Ambra trading as The World of Kolgennon.

 

1.2 These Terms

 

These terms and conditions apply to all orders placed through theworldofkolgennon.com. By placing an order, you confirm you have read, understood, and agree to these terms. We may amend these terms from time to time; the version in force at the time you place an order is the version that applies to your purchase.

 

1.3 Products

 

We sell two categories of products:

 

Physical products, including art prints, which are produced and shipped on a print-on-demand basis by our fulfilment partner, Printful. Printful prints each item after your order is placed and ships directly to you.

 

Digital products, including ebooks and downloadable files, which are delivered electronically via a download link sent to the email address provided at checkout.

 

Product images are illustrative. Slight variations in colour, paper stock finish, and trim may occur between the on-screen image and the delivered product owing to the nature of print-on-demand manufacture and individual device displays.

 

1.4 Orders

 

Placing an order constitutes an offer to purchase. Your order is accepted when we send an order confirmation email. A contract is formed at that point. We reserve the right to decline any order at our discretion, including where a product is unavailable, where an error in pricing or description is identified, or where we suspect fraudulent use.

 

1.5 Price and Payment

 

Prices are shown in GBP and are inclusive of any applicable VAT. We are not currently VAT-registered, and no VAT is charged on our sales. Shipping costs, where applicable, are calculated at checkout based on destination and product. Payment is taken in full at the point of order via our payment processors (Wix Payments, Stripe, or PayPal, as selected at checkout). We do not store payment card details.

 

1.6 Delivery

 

Physical products are dispatched by Printful from their UK fulfilment facility where available. Estimated production time is 2–5 working days; estimated UK shipping time is 3–7 working days after dispatch. Total estimated delivery time is 5–12 working days. These are estimates, not guarantees.

 

Digital products are delivered by download link sent to your email address on receipt of payment. Links are also available on the order confirmation page. If you do not receive your download link within one hour of payment, please contact us at theworldofkolgennon@gmail.com.Risk in physical goods passes to you on delivery. Title passes on receipt of full payment.

 

1.7 Your Right to Cancel (Consumer Contracts Regulations 2013)

 

For physical products, you have the right to cancel your order within 14 days of receipt without giving a reason, in accordance with the Consumer Contracts Regulations 2013. See our Returns and Refunds Policy for how to exercise this right.

 

For digital products, by completing your purchase and consenting at checkout to immediate delivery, you expressly acknowledge that you lose the right to cancel once the download has begun. This exclusion is permitted under Regulation 37 of the Consumer Contracts Regulations 2013.

 

1.8 Faulty or Damaged Goods (Consumer Rights Act 2015)

 

Your statutory rights under the Consumer Rights Act 2015 are not affected by these terms. If a physical product arrives faulty, damaged, or differs materially from its description, contact us within 14 days of receipt with photographs of the issue and your order number. We will arrange a replacement or refund. If a digital file is corrupted or will not open, contact us for a replacement file or refund.

 

1.9 Intellectual Property

 

All written content, artwork, designs, illustrations, maps, lore, characters, place names, and other creative material on this website and in our products — including but not limited to material associated with The World of Kolgennon and A Scattering of Leaves — is the intellectual property of Lewis D'Ambra and is protected under UK and international copyright law.

 

Purchase of a physical or digital product grants you a personal, non-transferable licence to use the product for private, non-commercial purposes. You may not reproduce, redistribute, resell, publicly display, adapt, or create derivative works from any product or content without our express prior written permission.

 

1.10 Limitation of Liability

 

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

 

Subject to the above, our total liability to you for any loss arising from or in connection with an order is limited to the value of that order. We are not liable for any indirect, consequential, or economic loss.

 

1.11 Governing Law

 

These terms are governed by the laws of England and Wales. Any dispute arising from or in connection with these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
